Universities Have Rules Governing Intimate Violence 政大證實林姓男友讀博士班 涉暴力最重退學

National Chengchi University has confirmed that DPP legislator Kao Chia-yu's boyfriend surnamed Lin is enrolled in a doctorate program at the university. If the allegations are proven true, he may be expelled based on the university's student code of conduct.

Schools have provisions in their code of conduct for students to respond if undergraduate and postgraduate students who are of age commit any form of violence. The circumstances will determine whether a minor demerit or major demerit is issued. However, if the victim of the physical violence is a partner also attending the school or an off-campus partner, are there any regulations that the school can use? National Taiwan University and National Taiwan Normal University have both included intimate partner violence in their code of conduct. The latter recently amended the provisions to standardize them.

Lin Mei-chun, VP, Office of Student Affairs, NTNU: “The punishment for sexual assault, sexual harassment, and gender-based bullying depend on the severity of the circumstances. If someone commits a crime that is punishable by a minimum of three years, then the person will be expelled.”

NTNU says using school rules and regulations to regulate the personal behavior of adult students is a necessary evil. Although it would prefer to use education and mentoring as responses, any violations of laws need to be dealt with. Some students agree.

Ms. Liu, National Taiwan Normal University Freshman: “I think school regulations should keep pace with criminal law.”

Mr. Chen, National Taiwan Normal University Freshman: “In the end, you're still a student, so it would be better to use school rules and regulations to teach you. You're not a full member of society yet, so they won't be so harsh on you.”

NTNU says judicial trials take time, and whether offenders can still continue attending school during this time is a difficult problem. However, if the victim is also a student in the same department or school, it can launch a gender equality investigation. If the persons involved are attending the same classes, they will be separated.

 

已成年的大學生和碩博生若涉及暴力，各校獎懲辦法早規定，按情節記小過或大過，但若施暴對象是同校男女朋友或校外伴侶，學校有法可管嗎？台大和台師大已把親密關係納入學生獎懲，台師大近日再修改辦法，希望有所規範。

台師大學務長林玫君指出:「性侵害、性騷擾跟性霸凌的部分，根據情節的輕重來訂定獎懲的一些辦法，如果說他的這個情節已經達到本刑3年以上的話就會予以退學。」

以校規來規範成年學生個人行為，林玫君認為是必要之惡，因為雖然期盼用教育，輔導宣導來處理，但一旦觸犯到法律邊緣，校規懲處仍有其必要，部分大學生也表示贊同。

台師大教育學院不分系一年級劉同學說:「刑法之外我覺得校規是可以跟上的。」

台師大機電系一年級陳同學則認為:「因為你還是一個學生所以還是用校規來去教育你，你還沒有出社會，就對你沒有那麼的嚴苛。」

不過林玫君說，司法審判需要時間，加害學生是否還能到校學習，是個難題，但假若當事人皆為校內甚至同系學生，除了啟動性平調查，若修同樣的課，一定會隔開修課來處理。
