The Kuomintang announced on Feb. 17 that it has asked Broadcasting Corporation of China Chairperson Jaw Shaw-kong to join its Central Advisory Committee. The National Communications Commission responded that it will have to determine if he is in violation of existing regulations if Jaw accepts the offer.
Broadcasting Corporation of China Chairperson Jaw Shaw-kong announced earlier this month that he is rejoining the Kuomintang. On Feb. 17, the KMT said it is appointing Jaw to its Central Advisory Committee. This prompted the National Communications Commission to say that Jaw may be in violation of regulations governing the withdrawal of political parties, government, and military from media operations if he accepts the appointment. It said it will immediately investigate and fine BCC NT$2 million if there are violations.

Why is the NCC so overly concerned about Central Advisory Committee member appointments? You shouldn't be able to expand definitions like this to say that someone is a political party worker. Taiwan has become a one-party dominant system, and the Democratic Progressive Party shouldn't be dominant to this extent.
The enforcement rules don't apply to consultants of an advisory nature. Under our party charter, central advisory committee members are consultants of an advisory nature with no decision-making powers.
Article 3 of the Enforcement Rules of the Radio and Television Act states that the term "political party worker" refers to a person holding a position specified in the charter or organization framework of a political party, but not those holding consultative positions. Central Advisory Committee member is a position specified in the KMT's charter. KMT Chairperson Johnny Chiang said these members hold consultative positions and aren't paid, and therefore they not limited by the enforcement rules. Jaw said the NCC should be an independent body, but it is doing the work of a single political party. He added he will file an administrative lawsuit if the NCC issues a fine.

Jaw has made no secret of his intent to run for KMT chair. Being a member of the Central Advisory Committee gives him the qualifications to run. However, the KMT also has a regulation stating that candidates have to be a party member for at least one year to be eligible, so the Central Standing Committee will have to amend regulations to make him eligible.

國民黨黨主席 江啟臣表示：「但顧問性質者，不在此限。我們的中評委，根據黨章相關規定，他就是建議性質諮詢性質顧問，他沒有決策權。」
根據「廣播電視法施行細則」第三條，黨務工作人員指的是政黨章程、組織架構明定職位之人員，而中評委屬國民黨黨章中明確職位。國民黨黨主席江啟臣則強調，中評委屬於不受薪的「顧問性質」不在此限。趙少康反批NCC身為獨立機關為政黨服務，若NCC開罰，他也將反制提出行政訴訟。
NCC副主委發言人 翁柏宗表示：「我們就是會啟動行政程序去調查，也會函請相關的當事人，陳述意見。有這樣的罰款(規定)20到2百萬，不改善的話，就按次的處罰。」
NCC表示將函請當事人陳述意見，若調查屬實違反廣電法，可開罰20萬至200萬元，不改善可按次處罰。趙少康近日頻頻表態有意參選下任黨主席，擁有中評委資格後，將拿下參選的門檻，但國民黨內也規定，黨籍滿一年才能參選，趙少康是否符合參選黨主席規定，還要視中常會是否修改規則。
