Over 80% Mediation Cases Resolved in 2018|去年申請調解逾14萬件 成立比例突破8成

In general, when there are civil or criminal disputes, many people want to go to court to present their case. According to Ministry of the Interior statistics, however, the number of applicants for mediation across Taiwan in 2018 totaled over 140,000. Over 80 percent were resolved successfully, which was a historic high. This equates to a successful resolution every five minutes.
The mediator discusses a compensation agreement with the two sides. This is a common scene at township and district offices around Taiwan.
We hold half-hour mediation sessions every Wednesday and Friday. We process 15 to 20 cases per session or 50 to 60 a day.
We generally don't continue with mediation when the two sides are very emotional or too far apart. In cases where the two sides agree on what happened, we are more often successful. When local cases (like) leakage disputes are resolved, it actually promotes harmony within the community.
Most township and district offices have a mediation committee made up of legal and professional experts. According to the Ministry of the Interior, over 140,000 cases went to mediation in 2018 with a record 80 percent successfully resolved. Of this number, 65.4 percent were criminal cases with car accidents and personal injury cases making up the bulk. The 34.6 percent that were civil cases mostly involved credit and debt disputes.
On average, there is a successful resolution every five minutes. When a case is resolved (through mediation regulations), the agreement is sent to the court with jurisdiction for approval. The agreement is legally binding and has the same legal standing as a court ruling.
The ministry says mediation not only eases the burden on the judicial system, but is also an effective form of resolution that more people should consider.

北市中正區公所調解委員會秘書 呂文宏表示:「每個禮拜三或禮拜五,我們有固定的時間。(舉例)每半個小時一場,那場次幾乎都有快15件到20件,一整天調下來,大概都有50、60件這樣子。」
調解委員 陳俊廷表示:「雙方真的,情緒或者是意見(分歧)非常大的時候,通常,我們也不會讓這個案件,要進行冗長的一個調解,(另外)對於事實認定也比較沒有出入的話,那我覺得這種案件,就是比較容易成功,尤其是很多,(舉例)像漏水糾紛的這種,幫助一些里鄰,相處之間的一個和諧。」
全台各地的鄉鎮區公所,普遍設有調解委員會,找來具有法律或專業知識的調解委員,協助釐清問題、化解紛爭。根據內政部統計,107年全台受理「調解」件數,超過14萬件、調解成立率突破八成,創下歷年新高。其中有65.4%是刑事案件,以車禍等傷害案最大宗,至於34.6%的民事案件,是債權、債務糾紛最多。
內政部民政司副司長 鄭英弘表示:「大概每5分鐘,就有一件的調解成立,(按鄉鎮市調解條例)調解成立的話,送經管轄法院核定後,它的效力,等同於法院判決。」
內政部指出,調解制度不只能減輕司法負擔,有時候更能「化干戈為玉帛」,因此也建議民眾,除了上法院對簿公堂之外,也可以選擇效率更高的「調解」,作為解決問題的選項。
