Executive Yuan Produces Anti-Stalking, Harassment Draft Bill 跟蹤騷擾防制法草案 政院版本確定

The legislature has taken no action on a draft bill aimed at preventing stalking and harassment for the past five years. There are calls for the government to take action following the recent killing of a Pingtung woman. The Executive Yuan discussed its version on April 22 and defined eight types of stalking and harassment offences.
A Pingtung woman was recently killed by a stalker, prompting calls for the government to stop procrastinating on a law aimed at preventing stalking and harassment. The Executive Yuan has completed its version and legislators are monitoring the Ministry of the Interior’s approach. Interior Minister Hsu Kuo-yung said the draft bill defines stalking and harassment as crimes to ensure that the police will be able to investigate.

According to reports, the Executive Yuan version of the draft bill explicitly defines eight types of stalking and harassment offences. They include surveilling or stalking a specific person; waiting at or approaching a location where a specific person is at; making threats or verbally abusing someone; harassing someone over the phone or Internet; requesting meetings; sending images or text; slandering; and misusing someone’s personal information. The maximum sentence is five years. The crimes can be prosecuted without complaint.
I of course hope it can be passed as soon as possible. Our police will absolutely implement it according to the law once it is passed. It should help laws in Taiwan related to gender equality and other related issues to take a step forward.
Hsu said many civic groups reviewed the Executive Yuan’s version, and it will take one week’s time for the version to be submitted to the legislature for review. He added that if the law had been passed earlier, the tragic death of the Pingtung woman could have been avoided.
日前屏東發生一名女子不幸遇害,因為她受到愛慕者擄殺,引發「跟蹤騷擾防制法」草案的討論,多方認為不能再拖延,行政院版本通過,多位立委也關切內政部的態度,部長徐國勇指出,草案將跟騷定義為犯罪,警察進行調查就沒問題。
內政部長 徐國勇表示:「因為他是犯罪,我們當然就可以偵查,這個就沒有問題,我們在這裡警察的角色相當吃重,會有書面告誡,這個警告就由警察機關來予以告誡,告誡以後,如果再違反等等相關,就會有保護令等相關問題。」
根據了解,政院版的「跟蹤騷擾防制法」草案,將明確定義8大類跟騷樣態,包括監視、跟蹤特定人,守候或尾隨接近特定人出入場所,有威脅、嘲弄等行為,以電話或網路干擾對方,或是要求約會,或有傳送圖文影像方式,損害名譽,以及濫用對方資料,最重將處5年徒刑,非告訴乃論罪。
內政部長 徐國勇表示:「當然我也預期能夠越快越好,讓它通過,我們警察機關對於通過後的執行,一定會按照法律規定處理,應該會讓台灣有關性平等等相關的這些法律,會更向前邁進一步。」
徐國勇指出,政院版本有經過多個團體參與討論,在立法程序上約再經過一星期的時間,就可以正式進入立法院排審,同時他也坦承,若跟蹤騷擾防制法能早一點完成立法,就有機會阻止發生屏東女子被殺害的憾事。
