Legislator Yen Taking Action to Tear Down Portions of the Private Guesthouse 顏寬恒自拆違建 強調爭議已久.勿無限上綱

KMT By-election Candidate Yen Kuan-heng took action to tear down an extra illegally constructed 500 square meters of his family's private guesthouse.

KMT's by-election candidate for Taichung City's second electoral district Yen Kuan-heng was seen operating heavy machinery at the site on Dec. 7 as a show of taking actions to tear down his family's private guesthouse located in Nantun District of Taichung. Yen family's private guesthouse was built on land they purchased years ago but the piece of land has already been announced by the government to be for public infrastructure use. It has come to the attention of many lately that the Yen's had illegally constructed on an extra 500 square meters of land. Yen finally asked workers to take down parts of the house on Dec. 7.

Yen Kuan-heng, KMT By-election Candidate, Taichung 2nd Electoral Dist.: “I'll do everything according to the law. I'll tear down the illegal parts of the building, even if it's my younger brother's house, but I'd like to say that we are the victims as the owner of this piece of land that later became land reserved for public infrastructure.”

Yen said he would go by the law, but he also complained about the government's bad urban planning. He said the government had not actually expropriated the land and his family could not sell the piece of land either. The Control Yuan pointed this problem out to the Ministry of the Interior back in 2013, Yen said. He is asking officials and fellow politicians to stop the criticisms. DPP's by-election candidate Lin Ching-yi said it is a fact that the Yen's had illegally constructed more than they were supposed to. Yen should not call himself a victim.

Lin Ching-yi, DPP By-election Candidate, Taichung 2nd Electoral Dist.: “He said he is going by the law, and it is a fact that his family had illegally constructed more than what's allowed on expropriated land. It is evident that they broke the law, so how can he portray himself and his family as victims?”

The Taichung City Urban Development Bureau said they had officially notified the Yen family on Nov. 29 to tear down the illegally constructed portions of their guesthouse by Dec. 13. The bureau will keep monitoring the process if demolition is not completed by the date.

Hsieh Kuo-chi, Chief, Urban Restoration Engineering Sec., Urban Dev. Bureau, Taichung: “The owner of the property on 817 Fong Shu Duan in Nantuan District, land reserved for public infrastructure, is now removing the illegal construction. We will keep the process in check until demolition is completed.”

To deal with controversies in land reserved for public infrastructure but has remained idle, the Taichung City Government said they have written up and sent in to the Ministry of the Interior a draft for reviewing public facility planning in Taichung. Taichung officials are looking towards cross-district urban land consolidation as new urban planning.  

 

親自操作重型機具，象徵性破壞牆面，國民黨台中市第二選區立委參選人顏寬恒，面對外界連日質疑家族招待所、位於南屯楓樹段817地號公共設施保留地上，有500平方公尺違建，7日上午自行請來工班拆除。

國民黨中二選區立委參選人顏寬恒表示:「一切依法辦理，即便是自己弟弟的房子，違章就要拆除，但是我們要聲明，持有公保地，我們才是受害者。」

顏寬恒強調拆除違建一切依法處理，但公保地地主在政府錯估都市計畫下，面臨土地沒有徵收也無法轉賣，2013年監察院甚至為此糾正內政部，外界不應該無限上綱。不過民進黨台中市第二選區立委參選人林靜儀認為，招待所違建是事實，顏寬恒不應該將自己形塑成受害者。

民進黨中二選區立委參選人林靜儀認為:「他也說是依法行政，在公保地上面蓋違建是明確的事證吧？是明確的違法吧？那明明就做了違法的事情，該拆就拆他自己也說了，這樣子到底哪裡委屈？」

台中市都發局表示，上個月29日已發函，限期顏家12月13日前自行拆除違建，若未拆除完畢，將持續監督到全數拆除為止。

台中市都發局修復科長謝國基指出:「南屯區楓樹段817地號，公共設施保留地涉及違章建築部分，今天已由違建所有人自行拆除中，都發局將持續監督至拆除完畢。」

至於公保地爭議，台中市府指出，已研擬台中公共設施用地專案通盤檢討草案，送內政部都委會審議中，未來將以跨區市地重劃方式辦理整體開發。
