HIGH COURT RULES FREEZING KMT ASSETS ILLEGAL|國民黨帳戶遭凍結 法院裁准"停止執行"

The Kuomintang has NT$460 million in the bank, which has been frozen by the Ill-gotten Assets Committee. This has caused the KMT to be unable to pay wages to its workers. Thus, they have appealed to the Taipei High Administrative Court to temporarily unfreeze the assets. After review, the court said that the account can not be frozen until an administrative proceeding is established. The IGA Committee said it will appeal. The Taipei High Administrative Court said that the Ill-gotten Assets Committee cannot freeze the Kuomintang's bank account as a sanction as there are legal errors in the process. ==HSU JUI-CHU, Spokesperson, The Taipei High Administrative Court== Banks are for-profit businesses, what sort of a position or authority does it have to freeze assets? This is in fact contrary to the principle of clarity and is a very important reason for our ruling The ruling which is favourable to the Kuomintang is a rebuke to the IGA Committee. The Committee later said it was reluctant to endorse the High Court's decision and thought that its explanation had contradictions. ==WELLINGTON KOO, Chair IGA Committee== We will appeal what they have ruled is an illegal action. If the court thinks our administrative sanctions on the KMT are not clear enough we will have a discussion and make a further decision on what to do. Koo emphasized that the IGA committee would definitely appeal. Meanwhile, the KMT thanked the court for its ruling and asked the IGAC not to make life hard for its workers. ==CHIU TA-CHAN, KMT Management Committee== The ruling shows that what we originally advocated was correct. We have always believed that no matter how much dissatisfaction there may be with the KMT, it is no reason to take it out on the workers. Chiu further said that it was currently very hard for the KMT to carry out any of its party work and there was still no way to resolve paying out the November salaries as before the second verdict, the account could not be unfrozen.
