Relaxing Restrictions for Issuing Amber Alerts Debated|防兒少網路誘拐 兒福促放寬"安珀警報"

The issue of kidnapping of minors has attracted much attention after this incident. The National Police Agency and Facebook signed an agreement back in 2016. When a child is reported missing, social media platforms can issue alerts to inform netizens and get their help in searches. However, numerous conditions must be met before an alert can actually be sent. As a result, in the four years since this agreement was signed, not a single alert has been issued. The Child Welfare League Foundation urges the authorities to relax restrictions so the mechanism can serve its purpose.


A 14-year-old Kaohsiung resident was missing for three days before being recovered at the home of her kidnapper in Hsinchu. The Child Welfare League Foundation subsequently convened a press conference to address the issue of the kidnapping of minors. It said the National Police Agency and Facebook signed an Amber alert agreement in 2016. This means that as soon as a child is reported missing, social media platforms will issue alerts to inform netizens and get their help in searches. However, numerous conditions must be met before an Amber alert can be issued. As a result, in the four years since this agreement was signed, not a single Amber alert has been issued.

They need to relax the restrictions on the issuing of Amber alerts, and expand applicability from kidnapping and extortion. The alert should be issued if any child is kidnapped and the legal agent consents.

The CWLF worries that there are numerous cases of cyber scams that aren't considered. NPA statistics show there were over 4,000 cases of minors running away from home in both 2017 and 2019. The number was 3,900 in 2018. The majority of runaways were junior high school students, and the average age of a first-time runaway was 14. Moreover, 30 percent sought help from online friends after running away.

If everyone is constantly issuing Amber alerts, then this system may lose effectiveness and people will lose faith in it. We're really willing to discuss things (with Facebook) about whether we should relax restrictions.

The NPA said there needs to be discussions with Facebook before restrictions on issuing Amber alerts can be relaxed. There have also been cases where netizens got involved by conducting human flesh searches and sharing information about perpetrators to help search for missing people. However, civic groups worry that media reports about perpetrators may violate Article 69 of the Protection of Children and Youth Welfare and Rights Act as well as endanger victims.

The personal information of more and more perpetrators is being exposed online. We are very worried that perpetrators will feel that there is no escape when this information is exposed online and will take extreme measures.

There have also been cases where children run away again after returning home. Legislators say the tracking guidance mechanism needs to be strengthened and dysfunctional households need greater care. They will also seek to amend the act.



高雄14歲少女失蹤三天後,終於在新竹嫌犯家被尋獲。面對這類未成年遭誘拐失蹤案件,兒福聯盟指出,105年我國警政署與臉書簽訂「安珀警報」,一旦出現兒童誘拐事件時,可以透過社群媒體發布警示與網友的力量協尋,但啟動安珀警報的條件過於嚴苛,四年來卻從未啟動過。

兒福聯盟政策中心主任 李宏文表示:「安珀警報通報要件,必須要鬆綁,從所謂綁架勒索,擴大到只要兒少遭到誘拐,經過法定代理人同意,就可以發布這樣協同的警報。」

兒福聯盟擔心還有更多遭網路誘騙的黑數沒有浮上檯面。根據警政署統計,未滿18歲兒少離家,106年、與108年每年都超過四千人、107年3900多人。大多發生在國中階段,首次離家年齡平均14歲,其中更有三成離家後投靠網友。

刑事局犯罪預防科研究員 林標油表示:「大家一直發布(安珀警報),這個系統可能沒有(效力),造成大家不相信,狼來了效應。很願意跟他們(臉書)談談,是不是(鬆綁)寬一點、闊一點。」

警政署回應要跟臉書溝通研議,放寬安珀警報標準。此外,不少網友案發後,透過肉搜比對嫌犯網路個資,協尋少女下落,但民間團體憂心,透過媒體加強報導加害者線索,恐怕違反兒少法69條,也將被害人推入險境。

iWIN網路內容防護機構執行秘書 劉昱均表示:「越來越多加害者的資料,被曝光在網路。這些至關重要的線索,曝光在網路上面的時候,我們極擔心,加害人覺得自己無可逃了,進而對被害者,進行更激進的手段。」

此外也有不少案例在兒童返家後,卻又再度離家,立委認為應強化追蹤輔導機制、關懷功能失衡家庭,後續將提出「兒少福利權益保障法」相關修正。
