According to reports, Internet celebrity Lady Nai Nai and her family have immigrated to Canada and are seeking refugee status. Immigration lawyers say the refugee status application process could drag on for one to two years.
Internet celebrity Lady Nai Nai and her husband recently absconded with money and fled Taiwan with their family. On Jan. 9, it was reported that they had arrived in Canada. They were flagged by the Canada Border Services Agency upon entry, but as their documents were all in order, they were allowed to enter. The National Immigration Agency has confirmed the family has already entered Canada. It applied to the Taipei District Prosecutors Office for an arrest warrant, which was issued on Jan. 8.
Based on the timing, she entered before Jan. 8, so at that time, a Canadian official said the Canadian government didn't have any record of a criminal case.
According to reports, Lady Nai Nai is applying for refugee status. Canada allows people to apply as "convention refugees," which is for people who have faced persecution as a result of their ethnicity, religion, or other factors. People can also apply as a "person in need of protection" if they will face the death penalty or a cruel and unusual punishment upon returning to their country of origin. Immigration lawyers say Lady Nai Nai may indicate that Taiwan still has the death penalty on her application and use that to remain in Canada.
If my application is rejected at the hearing, I can still appeal. If my appeal is turned down, I can seek a temporary stay of protection in Canada on humanitarian or compassionate grounds. This process often drags on for one to two years or even longer.
Meanwhile, the Ministry of Foreign Affairs says it has so far received no order from judicial authorities to cancel the passport of Lady Nai Nai.
Up until now, the Ministry of Foreign Affairs has not received any notification from the Ministry of Justice for the Ministry of Foreign Affairs to communicate and coordinate with Canadian judicial authorities.
The Taipei District Prosecutors Office will collate relevant information and send it to the Ministry of Foreign Affairs' Bureau of Consular Affairs to determine if the passport should be canceled.
The Investigation Bureau has already determined Lady Nai Nai's address in Canada. Taiwan and Canada do not have an extradition treaty, so it will be up to Canada to decide whether or not to extradite her.
