To vaccinate or not, that's one of the most important decisions parents have to make. A young student in Chiayi died in Sepsis in 2012, That's three years after he received a flu vaccination. His parents believed that their son died of the side effects and claimed vaccine injury compensation, which was rejected by the Ministry of Health and Welfare. However, the Supreme Administrative Court ruled that, since the possibility that it could not be ruled out that the two incidents are related, the ministry must award the parents NT$2.09 million in compensation.
Looking at their son's room, Mr. and Mrs. Chen remain in sorrow. Eight years ago their son had H1N1 vaccine shot in school, but two year later he died from acute disseminated encephalomyelitis (ADEM) and septicemia.

His belongings evoke my memories of him. My two younger sisters feel so sad when they see me missing my son, they keep telling me to let go. How could I let go of him? My son simply got a vaccine shot and resulted to his death.
Mr. and Mrs. Chen requested the Ministry of Health and Welfare to issue them compensation. Supreme Administrative Court ruled, there was no way to completely eliminate all factors of vaccine shot associated with Chen's death, therefore the Ministry of Health and Welfare must compensate Chens NT$2.8 million and the verdict was final. This was the first case which court overruled the ministry's refusal of issuing compensation.

The chance for a vaccine shot associated with death two years later is negligible. The court verdict would make people having doubts over vaccine safety. It has negative impact for a nation to promote vaccine policy.

What we are worrying is the verdict of this case will influence people's willingness to have vaccine shots. That is a serious concern for our future disease control.
The Centers of Disease Control said to comprehend the court verdict, but they urge the general public to get vaccine shots for better disease control.

嘉義一名高職生陳威鴻,8年前在校接種H1N1新型流感疫苗,2年多後卻因為敗血症死亡,陳威鴻父母因而向衛福部申請救濟補償,歷經台北高等行政法院二次更審,最高行政法院認為,因為無法排除陳威鴻死因跟接種疫苗有關,判決衛福部要賠償他的父母208萬餘元,全案定讞。
看著兒子的房間,陳威鴻父母不禁再次感傷,因為八年前,兒子在校接種H1N1新型流感疫苗,兩年多後卻罹患急性瀰漫性腦脊隨炎併發敗血症死亡。

陳威鴻的父母因而要求衛福部核發救濟補償,最高行政法院認定,無法排除死因和接種疫苗有關,判決衛福部必須賠償208萬餘元,全案定讞,創下法院推翻衛福部拒發救濟金的首例。
