Four File for Petition over Lockdown of Hoping Hospital 17年前和平封院 4隔離員工向人權會陳情

The Taipei Municipal Hoping Hospital was ordered to lock down in 2003 to prevent the further spread of the SARS pandemic, with over 1000 hospital employees, patients, and their caretakers being forced to undergo collective quarantine. Although the incident took place 17 years ago, many people hwo lived through the lockdown said their lives have changed forever and they have been fighting with stigma and unemployment since then. Four victims have decided to come forward to file a petition to the newly-established National Human Rights Committee, demanding a thorough investigation and compensations.


On April 24, 2003, the Taipei Municipal Hoping Hospital was ordered to lock down after cluster infections of SARS occurred. The surprising move shocked everyone on the island, not to mention the 1,000-plus hospital employees, patients, and their family members who were in the facility. Seventeen years later, four people who lived through the lockdown made a petition to the National Human Rights Committee, claiming the incident was a "massive infringement of human rights."
 
The first right that was been infringed was the right to health and to life. Then there was the right to be free from fear. Some people's reputations were violated while other's right to work and their property rights were also infringed.

I got chronic asthma as a result of the lockdown. I would be gasping for air when I walk. Some people had to be treated with high doses of steroid or their hip joints replaced. One person hanged himself. I think a lot of human rights were infringed.
 
All Six laundry workers were infected, with one of them dying. Life hasn't been easy for the survivors either, as the remaining five people lost their jobs after the incident.
He received a heavy penalty and then he was dismissed from the job.
 
The four petitioners demanded a thorough investigation and compensations and their appeal has been accepted by the National Human Rights Committee. However, the commission is still unable to exercise its power and authority, as the relevant draft bill has been withdrawn after being blocked in the Legislature. It remains uncertain how it can address any issues raised in the appeal.
 
Article 4 of the UN's Two Covenants on Human Rights stipulated that all levels of governmental institutions and agencies should conform to human rights protection provisions, which of course should include the National Human Rights Committee. The Committee should be able to protect the people from infringement by others and promote realization of human rights.
 
Over a thousand people were forced to undergo collective quarantine, which have helped curb the spread of the SARS outbreak. Although the incident happened 17 years ago, the scar in their hearts remain.
 
Redeem our reputations and withdraw administrative sanctions on dismissal from our jobs.
 
It's a massive infringement of human rights.

2003年4月24日,台北市立和平醫院因為爆發SARS群聚感染,遭到勒令封院。突如其來的舉動,造成社會恐慌,更讓院內超過一千位的員工、病患與家屬處於極度恐懼之中。17年後,四位當事者,向國家人權委員會陳情,認為這是一起大規模的人權侵害事件。
 
律師 黃鈺媖表示:「第一個,就是健康權、生命權,還有就是說,免於恐懼的權利。還有人是受到名譽權的侵害,還有當然就是工作權跟財產權。」
 
前和平醫院住院醫師 林秉鴻表示:「得到慢性氣喘、鐵肺,走路就會喘,有些人高劑量類固醇治療,後來髖關節置換,有一個上吊自殺的。我覺得精神上的人權,侵犯滿多的。」
 
洗衣房六名員工全部染疫,一人死亡,封院事件之後,活下來的五個人,全部失去了工作。
 
周經凱太太 李宜殷表示:「隔幾天,就帶回來一張重罰的,到最後那一張,是兩大過革職。」
 
四名陳情人向國家人權委員會陳情,要求查明受害內容,給予賠償,此案已獲得受理。 但是國家人權委員會的職權行使法,不但在立法院卡關,日前也自行撤回草案重新檢視,現階段該如何落實人權保障,還受害者一個公道。
 
台灣人權促進會秘書長 施逸翔表示:「兩公約施行法第四條,就規範各級政府機關。當然也包含,國家人權委員會,應該要依照公約相關人權保障,去做到尊重人權、保護人權,跟充分實踐人權的國家義務。」
 
17年前為了防止疫情擴散,一千多人被迫集中隔離,他們染疫的人權,還留著一道傷口。
 
前和平醫院主任 周經凱表示:「恢復名譽,撤銷免職的行政處分。」
 
前和平醫院住院醫師 林秉鴻表示:「它是大規模的人權侵害事件。」
 
周經凱太太 李宜殷表示:「我們深信,正義終將得以伸張。」
