SUPREME COURT OVERTURNS HIGH COURT DEMOLITION ORDER|黎明幼兒園判免拆 公民審議會辯論未來

The Liming kindergarten in Taichung was facing demolition. However, on June 14, the Supreme Court gave a verdict reversing the Taichung High Court's verdict. Despite this, the kindergarten's future is still uncertain. A group of young people and academics launched a conservation movement for the kindergarten. They want to operate it on a community basis, and held a meeting with locals to collect their views. In 35 degree heat with no aircon, a meeting was held at the gate of the historic Liming kindergarten which attracted a lot of local residents to hear updates about the building's fate. ==MR. YOU local resident == How Liming will carry on, how the overall plan will change, is not something we can interfere in, if we can keep Liming kindergarten, it's such a great kindergarten, in our area, it would be much better for all of us. The kindergarten and its operating group were litigated against by Taichung City for forced demolition. This was upheld by Taichung's High Court. However, in June, the Supreme Court overturned the verdict, so that the building was not demolished. A group of young people and local academics launched a conservation movement for the kindergarten and want it to be operated by the local community, keeping its green space, garden and the old kindergarten building. ==YANG YOU-JEN Prof., Tunghai University Dept. Sociology== We hoped to use the areas between A and B as a garden path to avoid a heavy flow of traffic along there, we believe this method is feasible and will protect the local ecology and pedestrians, plus reduce the detrimental impact of urban development here. However, artificial diversion of water from the pond and the Liming creek means that the river now runs straight behind the kindergarten. In June, heavy rain washed away some of the foundations. The kindergarten Principal urged that the fourth overall planning review, which is currently being carried out, will allow the kindergarten to be public-run as a local culture and ecology green belt resource. Taichung City government can no longer sit on the fence and ignore the issue. ==LIN JIN-LIANG Liming kindergarten principal== After the Liming creek was diverted, the section we just saw, the whole part which comes towards the kindergarten, that whole area was inundated, but we hope that the kindergarten area can be preserved and together with the Liming creek will be a continuous green belt. The public meeting of the group championing the kindergarten's preservation hopes that this time there may be a victory against land redevelopment and preservation of green space. TRANSLATED BY：CLARE LEAR 台中黎明幼兒園原本面臨拆除命運，但最高法院在6月14號，判決原判失效免拆，發回台中高分院更審，但幼兒園的未來，卻還是個問號。 因此有一群年輕人和學者，就發起「黎明幼兒園保留行動」，要透過社區營造方式來爭取雙贏，也在下午的時候舉行現地公民審議會，來蒐集贊成和反對的意見。 超過35度的高溫，沒有冷氣的公民審議會，就在黎明幼兒園的大門口舉行，吸引不少社區居民前來了解。 ==居民 游先生== 黎明溝接下來 他們整體規劃是怎麼改 我們也沒有辦法(干涉) 然後可以保留像黎明幼稚園 這麼棒的一個幼稚園的話 在我們社區這邊 對我們來講應該會比較好 台中市黎明幼兒園與黎明自辦重劃會的配地訴訟，在今年六月最高法院判決緩拆，並發回台中高分院更審後，暫時躲過拆除的命運，一群由年輕人及社造學者，發起了「黎明幼兒園保留行動」，希望能透過社區營造，留下一片綠地，同時也能保住幼兒園。 ==東海大學社會系副教授 楊友仁== 黎明幼兒園 我們本身是希望爭取A區跟B區 中間我們是希望用園道的方式 避免大量的交通經過 所以相信這個方案 在制度內也是可行的 維護它的生態環境 人行 及減低這些開發的衝擊 不過已經人工改道的滯洪池和黎明溝，河道直衝黎明幼兒園的背面，六月間的豪雨已經沖垮部份地基，黎明幼兒園長呼籲，目前正在進行的是第四次通盤計劃檢討，希望能讓幼兒園「公共化保留」，打造重劃區的文教與生態綠帶，台中市政府不能再置身事外。 ==黎明幼兒園長 林金蓮== 那現在它(黎明溝)改道之後 剛剛看到的那段 就直接往黎明幼兒園的那個 所有的區塊全部衝進去 就希望這個以黎明幼兒園 能夠把它保留下來 然後可以串連黎明溝 整個綠帶把它連結起來 下午的這場公民審議會，「黎明幼兒園保留行動」規劃小組，也希望這一次，能作為重劃土地爭議的三贏方案。
