WOMAN FILES STATE COMPENSATION OVER POLICE NEGLIGENCE|單親媽攜子輕生 嬤求助警.礙個資須先筆錄

A woman in Tainan is filing for compensation from the government over what she claims is police negligence. Last December, her daughter and her grandson went missing and she was very worried because her daughter had shown suicidal tendencies. The police sat her down and spent a whole hour taking her statement. By the time they found her daughter and her grandson in a car, both had been dead. It was nearly 10pm of one day last November, Mrs. Kuo ran into police station and reported that her daughter was committing suicide with her one-year-old son. Mrs. Kuo requested for GPS positioning, but the police said, due to the Personal Information Protection Act, they must complete a record prior contacting telecommunication unit. ==MRS. KUO, mother to the deceased== I knelt down and begged that policeman for an immediate GPS positioning, please. The policeman surnamed Lin finally said, he must act in accordance, he told us not to be anxious. It took them an hour to finish a writing record. The police finally located Mrs. Kuo's daughter and granddaughter, but they were both dead. ==MRS. KUO, mother to the deceased== If he acted fast enough and helped positioning, would I sue him? Would I bring this up? Family members are filing for state compensation. Tainan City Police Department stated, the policeman followed standardized operation procedure. We can go ahead proceed with GPS positioning or other emergency measures, and we can write up record at later time. Lawyer emphasized, according to Article 16, No.3, it is to prevent harm on the life, body, freedom or property of the Party, the incident shall not be restricted by the Personal Information Protection Act. Tainan City Police said, the case is under legal procedure and they had already disciplined the policeman's improper attitude. TRANSLATED BY: ANTHONY LIN 去年11月，台南一名單親媽媽到警局報案，指稱大女兒帶著1歲大外孫失蹤，因為大女兒之前有輕生紀錄，所以衝到警局求救，要求協助手機定位，但警察礙於個資法規定，必須先做筆錄，一做做了一個小時，警方最後找到人，車內母子已經死亡，家屬不滿，認為延誤救援，提出國賠。 去年11月晚上將近10點多，郭媽媽衝進派出所裡面，報案說她的大女兒帶著1歲的兒子疑似要輕生，要求警方協助手機定位，但警方礙於個資法必須做完筆錄，才能夠連絡電信公司取得手機定位。 ==死者母親 郭媽媽== 跪在那個椅子求他說 請你幫我趕快定位 拜託 林姓警員後來沒辦法就說 他就要這樣做 規矩就是這樣 叫我們不要急了 光做筆錄就花了一個小時，一小時後警方終於找到女兒跟外孫，但是卻都已經死亡，家屬無法接受。 ==死者母親 郭媽媽== 他假如很快就幫我定位找到 我今天會告他嗎 我今天會提這個事情嗎 家屬認為警方延誤了救命時機，因此提起國賠。而針對這件案例，台南市警方表示，報案當下已經請警員協助尋找失蹤者，並表示警員先做筆錄再定位是符合SOP流程。至於爭取救命時效部分，警方表示未來受理報案的同時，可先請電信公司定位，事後再補正式筆錄。 ==台南市警局第二分局防治組組長 丁敏記== 如果說是情況急迫的狀況之下 我們可以採取權宜的措施 先查詢定位或其他 必要的緊急措施 再補做筆錄 律師強調，根據個資法在16條第3款，為免除"當事人"之生命、身體、自由或財產上的危險，可不受個資法限制。而南市警局澄清，本案目前已經進入法律程序，強調針對員警態度不佳的問題，已經祭出懲處。 記者 溫正衡 台南報導
