PRESIDENT TSAI TO NOMINATE A PREVIOUS JUDICIAL YUAN PRESIDENT|總統重提司法院長人選 許宗力呼聲高

President Tsai Ing-Wen will soon announce her judicial nominations, and former grand justice Hsu Tzong-Li is believed to be the most likely nominee for the president of the Judicial Yuan. However, some legal experts said Hsu cannot be nominated again since he had previously served as a grand justice. The Presidential Office made an announcement on Aug. 26 , stressing that the constitution does not forbid former grand justices who have not been in office for years to be nominated again by the new president. President Tsai Ing-Wen's previous nomination of Hsieh Wen-Ting and Lin Chin-fang as the president and vice president of the Judicial Yuan was withdrawn due to intense criticisms. In mid-August, President Tsai met with former grand justice Hsu Tzong-Li to hear his opinions. While there has been much speculation that Hsu is likely to be nominated, the Presidential Office said the official nomination will be announced in September. ==ALEX HUANG, Presidential Office Spokesman== When the decision is confirmed, the Presidential Office will call a press conference to announce the nomination. Because Hsu Tzong-Li had formerly served as a grand justice, some critics claim his nomination is unconstitutional. However, other legal scholars disagree. ==PROF. YANG YUN-HUA, College of Law, National Chengchi University== The constitution does not allow consecutive nomination, but Hsu has not been in office for many years. If he is nominated and approved again by the legislature, it means he is approved by the new government. The Presidential Office also made an announcement reiterating that the restriction on the consecutive nomination of grand justices is put in place to uphold the independence and impartiality of trials. A former grand justice nominated again by the new president would not be a concern, and is therefore not excluded by the constitution. Hsu Tzong-Li was also the dean of the National Taiwan University College of Law. With his extensive experience in both academia and the legal profession, the Presidential Office has expressed firm support for Hsu amid controversy.
