Man Sentenced to 5 Years for Eye Attack 屏東超商女店員挖眼案 嫌犯遭判5年定讞

A Pintung resident surnamed Yang has been sentenced 5 years in prison after he attacked a female clerk at a supermarket in the eyes. Many believed the punishment was too light.
The man surnamed Yang attacked the female clerk's face angrily when he was asked to stop smoking at the supermarket's entrance. He even gouged out her eyes. This attack took place in September 2021. Yang was sentenced to five years in prison for the crime. The prosecution refused to accept the sentence because Yang's attitude was not good after the attack and he did not reach a settlement with the victim. Prosecutors believed that the second-instance sentencing violated the principle of proportionality and fairness. However, the Supreme Court found the prosecution did not have a legitimate reason to appeal to the third instance. Yang's sentence was conviction affirmed to five years in prison.
Local Resident: “This is too light. He should've received at least 20 years in prison. What is the purpose of the 5-year sentence? It's scary.”
Local Resident: “He's a 40 to a 50-year-old guy with a lot of strength. He lives just next door to us. We're scared because we have kids. We dare not let our daughter stay at home alone. Our strength is not as strong as his.”
The 5-year sentence is generally considered too light by local residents. They are worried that after Yang has served his sentence, he will become a local headache as his family members have moved away and he will be without care and control.
Yang Teng-fu, Chief, Hsinnan Village, Pingtung: “He only got five years. We can see if he can live in a government institution after he comes out in five years.”
Citizen: “He should live in a nursing home to slowly adjust his mood after serving his time. And then slowly interact with people.”
Village residents are worried about the safety of going out, and understand that human rights cannot be affected. The village chief has suggested the county government and other relevant units provide Yang with professional counseling, companionship, and other active actions to reduce the chances of him committing another attack.
在超商門口抽菸遭制止,楊姓男子憤而攻擊女店員臉部,甚至摳挖她的眼睛,這起發生在去年9月的挖眼案,楊姓男子一審、二審因依傷害、重傷害未遂罪遭判刑5年,檢方不服,以楊姓男子犯後態度不算良好,也沒跟受害店員達成和解,認為二審量刑悖離比例原則、公平原則上訴,不過,最高法院認定檢方提出的不是上訴第三審的合法理由駁回,全案判刑5年定讞。
當地居民提及此事表示:「這個(判刑)太輕,最少要判20年,判那個5年要幹嘛?(楊姓男子)那麼嚇人。」
也有當地民眾指出:「他(楊姓男子)是40到50歲的人,力氣還很大,剛好住我們隔壁,有小孩我們會害怕,女孩的話我們也不敢讓她在家,他若在家,我們的力氣沒他大。」
5年刑期,當地居民普遍認為太輕,憂心楊姓男子服刑期滿後,因家人都已搬離無人照護、管束,反成地方頭痛人物。
屏東新南村村長楊登福回應:「他刑期就判了這樣5年,說這樣就可以5年,不然你就看他5年期滿出來,可以看(能不能)去住在政府的機構裡面。」
民眾認為:「(若期滿)應該在療養院靜養,再慢慢的去調一下心境,再來慢慢接觸人群。」
民眾憂心出入安全,也明白不能影響人權,因此將由村長代為向縣府等相關單位提建言,希望透過專業輔導、陪伴等積極作為,降低男子再犯機率,讓村民安心。
