Harassment Punishable by 5 Years of Prison 總統簽署跟蹤騷擾防制法 最重可判5年

President Tsai Ing-wen officially signed the stalking and harassment prevention law. It clearly states that the eight major forms of stalking and harassment, will be punishable by five years in prison. 


President Tsai Ing-wen officially signed the stalking and harassment prevention law, which came into effect and will be implemented in six months. The law passed the Legislative Yuan's third review on Nov. 19. The eight major forms of stalking and harassment, including surveillance, waiting, and trailing are punishable by up to five years in prison. If there is a risk of repeated crimes, preventive detention can be carried out. President Tsai also mentioned that now is the 25th anniversary of Peng Wan-ju's incident. She emphasized that this is an important step in the implementation to prevent and treat gender-based violence.

Tsai Ing-wen, President: “With this special law, legal power can intervene early to prevent harm from improper stalking and harassment. We can always do more and do better on this front. We will continue to work hard in the future to let all people live in safety and with peace of mind.”

Recently, there have been frequent violent incidents of abuse and assault, including DPP legislator Kao Chia-yu. Tsai declared the government's determination to enforce the law and wants the police to complete training and necessary manpower as soon as possible. The DPP legislative caucus also held a press conference to fully support Kao.

Fan Yun, Legislator (DPP): “We thank Jiay-u for standing up and will support her. Our Domestic Violence Law was passed in 1998. In 2007, it was extended to apply to cohabitation relations.”

The legislator stated that any violence should be condemned. This incident revealed that domestic violence and unauthorized sexual private images can be used as threatening weapons. The draft law proposed by Fan Yun has passed the first review and she is asking the Ministry of Justice to legislate as soon as possible.
 

 

 

 

總統蔡英文正式簽署跟蹤騷擾防制法,宣告生效並將在6個月後施行,跟騷法11月19日在立法院三讀通過,明確定義8大跟騷樣態,包含監視、守候、尾隨等,最重將可處5年徒刑,如果有反覆犯罪之虞,得預防性羈押,蔡英文也提到彭婉如事件滿25年,強調這是落實性別暴力防治重要的一步。

總統蔡英文表示:「有了這一部專法,未來對於不當的跟蹤及騷擾行為,公權力可以提早介入提早防範危害,在這一條路上我們永遠可以,做的更多做的更好,未來我們會持續的努力,讓全體的國人的生活更加的安全更加的安心。」

近來多起跟騷暴力事件頻傳,加上民進黨立委高嘉瑜遭到男友施暴,蔡英文藉此宣示政府執法決心,也要警政署盡快完成教育訓練及必要的人力增補。立院民進黨團也召開記者會全力聲援高嘉瑜。

民進黨立委范雲說:「我們謝謝嘉瑜站出來,也會支持她也為她一起加油,我們《家暴法》1998年就通過,2007年就把它擴大適用到同居關係。」

立委表示任何暴力都應該被譴責,而在這次事件中,凸顯家庭暴力和未經同意的性私密影像能被用來當作威脅的武器,目前范雲提出的專法草案已一讀付委,也要求法務部儘速立法。
