Taiwan Website Appears on "Notorious Markets List" 美"2020惡市場報告" 台灣"電影天堂"上榜

The Office of the United States Trade Representative released a review of notorious markets for counterfeiting and piracy, and Taiwan-hosted site "DYTT8" was listed for illegally providing pirated content. 


The website "DYTT8" is hosted in Taiwan, and provides torrent links to content such as movies or TV shows. All of the content is pirated. The website was listed in the Office of the United States Trade Representative's "2020 Review of Notorious Markets for Counterfeiting and Piracy" report, which is also known as the "Notorious Markets List."
 
This website's domain or address changes frequently. It may be in China today, in the US tomorrow, and in Taiwan or somewhere else the day after that. That makes it really difficult for the police to investigate. If you use BitTorrent to download content and then upload it, then you're essentially making a copy and sharing it publicly, which is a copyright violation.
 
The 2020 "Notorious Markets List" included 39 online markets in violation of trademark and copyright regulations. The majority were listed as being hosted in China. They included Baidu-operated Baidu Wangpan, Alibaba's Taobao, Shopee, and Pinduoduo. There were also 24 physical markets listed, including "Anfu Market, Putian, Fujian Province," "Asia-Pacific Xinyang Clothing and Gift Plaza, Shanghai," and "Huaqiangbei Electronic Malls, Shenzhen, Guangdong Province." This was DYTT8's second straight appearance on the list.
 
The US' Netflix platform is growing quickly. I think it's possible that the US may use this kind of list to protect its own industry. In terms of trade, it's about copyright. If Taiwan takes the correct preventative measures, this will help it when it seeks negotiations.
 
The pandemic means cinemas no longer have audiences, and people are choosing to stream content at home. A lot of the content is pirated. There are websites that allow people to stream pirated content without having to download it. The Intellectual Property Office says all that can be done is tracking down illegal servers, and people should respect copyrights and refuse to watch pirated content.
 
 
 
架設在台灣的"電影天堂"網站,打開網頁,有許多熱映院線大片,只要透過專屬下載器,才能網站上的"種子"連結,就能下載高畫質影片。但這些影片連結,都是未經授權盜版電影。如今引發美國貿易代表署關切。
 
經濟部智慧財產局著作權組組長 毛浩吉表示:「這個網站,它的那個網域或網址,它會隨著可能在…例如說,今天在中國大陸,明天在美國,後天可能會放在台灣,或者什麼等等。所以在警方查緝上面,就非常的困難。如果你用BT,你去下載,然後上傳你本身就構成重製,跟公開傳輸的行為,那原則上,會構成著作權的侵害。」
 
USTR,公布"2020惡市場報告",共列入39個涉及違法侵權虛擬網站,以中國網站最多,包括百度集團的百度網盤、阿里巴巴旗下的淘寶網,以及蝦皮、拼多多等。另外,也列出24個實體市場黑名單部分,包括福建莆田安福批發市場、上海亞太新陽服飾禮品市場、深圳華強北電子產品商業帶等。而台灣的電影天堂,連續兩年遭美國貿易代表署、USTR點名,涉及侵權、盜版。
 
律師 翁嘉君表示:「美國Netflix的平台,其實他們就是很大的一個成長。那我覺得,可能美國有可能做這樣公布,一方面,是要保護自己的產業,貿易上更進一步的話,其實在著作權,台灣這邊自己防範好的話,去爭取其他的談判的話,或許其實是會有正向的幫助。」 
 
電影產業指出,受疫情影響,全球民眾都宅在家,不少人透過串流影音網站收視,但隨著網路頻寬流量變大,現在盜版無所不在,像是過去"楓林網"、"安博盒子"等,已經不用下載影片,直接線上收看。智慧局表示,民眾收視並不違法,只能查緝違法伺服器,但防不勝防,呼籲民眾尊重著作權,拒看侵權與盜版,才能杜絕非法影音網站。
