TRA FAILS TO CHANGE WITH NEW LABOR LAW, AVOIDS OVERTIME PAY|台鐵產業工會控:輪班制度未改.規避加班費

Taiwan Railway Union members gathered in front of the taipei main station to protest yesterday morning. They said that since the new amendment to the labor standards act came into effects, their working hours remained the same but their overtime pay has be cut. If it continues, the members are planning to take their days off as permitted by the law during the lunar new year holidays. Taiwan Railway Union members demonstrated at the Taipei Station, because ever since the one fixed day off and one flexible rest day amendment became effective, the Taiwan Railways Administration failed to change work shifts. Work hours were not decreased, and the one-hour break in a 12-hour shift has increased to two-hour break, thus avoiding overtime pay. ==CHOU KAI Taiwan Railway Union Member== The extended break is a bluff. The management told us the break time is absolutely free time at own will, but it came with an added condition. They said if there something happens, the management can terminate your break time and call you back to stand by. Let me ask: is this really free break time? The Union also pointed out, the Taiwan Railways Administration said a 24-hour time counts as one day off or one rest day. As soon as a worker gets off from work , the clock starts ticking and it ends up workers not having sufficient time to rest. They demand the Administration returning legal full fixed day and rest day to employees and to recruit personnel, otherwise the Union may launch a series of legal days off during lunar new year holidays. ==WANG CHIEH Taiwan Railway Union Chairman== Since last negotiation until now, the Railways Administration showed no sincerity over negotiation. Therefore starting from now, we closed the negotiation door. We will take days off as permitted by the law. Facing with demand from the Union, the Administration said if passengers' rights are not being infringed, the Administration will respect the Union on taking days off. TRANSLATED BY：ANTHONY LIN 台鐵產業工會會員上午來到台北車站前表達不滿，因為一例一休上路後，台鐵根本沒改變輪班制，不但工時沒下降，還把員工12小時工時內的休息時間拉高，從原本的休息1小時，拉高為2小時，藉此規避加班費發放。 ==台鐵產業工會會員 周鍇== 延長的休息時間裡面 這根本就是虛假的休息時間 他有跟大家講說 休息時間是完全自主時間 可是後面有一個但書 假如說一旦有事情發生的時候 雇主可隨時中止你的休息時間 讓你回來待命做事 請問一下 這樣子是真正的休息時間嗎 台鐵產業工會也說，鐵路局主張只要是連續24小時就算是一天休息日或例假，在這個前提下，員工只要一下班，就開始計算24小時的休息或例假，造成員工天天出現在車站，因此要求鐵路局要將完整的休假日和例假日還給員工，並儘速補足人力缺口，否則不排除春節將依法休假拒絕輪班。 ==台鐵產業工會理事長 王傑== 我們認為說 既然從上次一直到現在 鐵路局都沒有任何誠意協商 我們從現在開始就關閉協商大門 我們就完全朝依法休假來推動 面對員工的訴求，鐵路局表示，在不影響旅客權益之下，會尊重工會依法休假。 記者 吳雅瑜 陳信隆 台北報導
