MINISTRY OF LABOR CLARIFIES LEGISLATION ANOMALIES|勞基法新舊制銜接 部分勞工特休有疑慮

發布時間: 更新時間:
Next month the new labor law comes into effect. However, there are many aspects to it which still lack clarity. For example, after working for six months, workers are entitled to three days' annual leave. However, under the previous system, some workers unable to take leave were not paid for their unused leave. Now they have to be paid for untaken leave, but this is not made clear. Also, due to the calculation for overtime pay on the flexible rest day, workers could work longer for less pay. Legislators threatened to launch a temporary proposal for the Ministry of Labor to clarify the amendments. Yesterday afternoon, the Ministry of Labor announced an about-face in policy with a new trial formula. Next month the new labor law comes into effect. After six months' work, staff will be entitled to three days holiday, but it is unclear in the legislation if they are entitled to pay if they cannot take the leave. Under the old system, they would have lost the leave and would not get any pay for it either. ==HSIEH CHIEN-CHIEN Sect. Head, MOL Gender Equality and Discrimination == At the end of the year, if staff have not taken their time off and don't have time to take it, under the old system, the employer did not have to pay them. So, under the new system, the employer should really give them pay for those three days. The employer should give pay for leave which has not been taken, but this has not been made clear in the legislation. Also, the calculation for overtime pay for flexible rest days has been questioned by legislators as being unclear. The MOL version was: overtime pay for under 4 hours on the flexible rest day, is calculated according to a four hour period, based on the hours and the basic monthly wage. However, overtime from the 9th to 12th hours is calculated at 12 hours but without being based on the number of hours worked so far. So on a NT$36,000 a month wage with standard hours, the hourly rate would be NT$150 an hour; so overtime from 1 to 8 hours should be an average of NT$388 per hour. However, those 8 hours would then be added into the basic rate when working over 12 hours, making the overtime rate only NT$342 an hour. This means that staff working longer hours would get less pay. Labor analyst pointed out that this was unreasonable. ==CHIU CHUN-YAN Law Prof. Chinese Culture University== The law is designed to stop the employer making staff work on flexible rest days. But, from the employer's point of view, instead of 8 or 9 hours, they may as well work 12, as this will lessen their pay. Legislators think that basic pay should be given differently for work over 8 hours and threatened to launch another proposal so that the Ministry of Labor would clarify the anomalies. The Ministry of Labor then made a sharp policy turn in the afternoon and said that on flexible rest days, from the 9th hour of overtime, employers must give regular overtime pay based on the standard monthly wage hours.
