The review of Public Television Service's new board began on Nov. 9. None of the five review representatives nominated by the Kuomintang's legislative caucus attended. The KMT also raised opposition to board seats being partisan for the Democratic Progressive Party and the date of the next meeting has not been set.
The KMT's review committee members were all absent. This sets an extremely malevolent precedent. This is a clear-cut case of political ransom.
The 15-member legislative committee tasked with reviewing Public Television Service's new board convened on the 9th. The Kuomintang's five representatives did not attend.
(If the majority party) holds three-fourths, it will be approved. For a minority party, they just need to hold one-fourth to stop the review process. Is this reasonable?
They took a leave of absence. In reality, we know what they are doing and they are taking away other people's rights. The review committee should not be making the controversy worse.
The Kuomintang caucus issued a statement saying some of the committee members had prior engagements while others were in quarantine. It also raised opposition to board seats being partisan for the Democratic Progressive Party and previous rejects getting repeat nominations. It called on the government to nominate a board that meets social justice expectations. Under relevant laws, board nominees can be approved with three-fourths approval, but it is unclear whether that means three-fourths of the entire 15-member committee or three-fourths of the committee members in attendance. This and other legal issues were also discussed at the meeting.
The lowest standard of one-half means seven members in attending. For the approval threshold of three-fourths, it's the approval of around five or six members. Last time, three-fourths meant 11 members.
Other people might see it differently and politicize it rather than seeing it from a legal standpoint. We don't need to get the board approved today and bear the burden of all these sins.
Following two hours of discussion, there was a consensus to clarify the three-fourths regulation, and for the actual review to be held during the next session.
If in the future PTS has the opportunity to amend the law, I think some clarification would be better.
Lee said the law should be revised if possible. Under the Foundations Act, the tenure of the current board will be extended until the new board is approved. The date of the next meeting has not been set.
文化部長 李永得表示:「國民黨所推舉的審議委員,這個集體缺席。這件事情,是創下了一個非常惡質的案例,那麼這個就是赤裸裸的,叫政治綁架。」
文化部長李永得,對於審查委員缺席,感到遺憾。公共電視第七屆董監事審查會議,在9號舉行,由立法院各黨團推派的15名審查委員來審議,但國民黨團所推薦的5名委員,全數請假、未出席。
公視董監事審查委員 黃世鑫表示:「(大黨)掌握3/4的話,就通過。小黨的話,它只要掌握1/4,有沒有,他就可以杯葛,被審查的這個董監事,合理嗎?」
公視董監事審查委員 謝啟明表示:「他們現在的名義是請假,實際上,我們都了解,可能就是杯葛。他說請假,然後你這樣,直接就把人家的權益拿掉了嗎?審議委員,不應該把這個爭議,越搞越大?」
國民黨立院黨團發表聲明,指出有些委員行程已經安排、還有人在檢疫隔離,除此之外,名單有黨派色彩,還有被否決過的人選被提名,因此希望能選出超脫黨派、符合社會公正的人選,建議擇期開會。而依照公視法規範,董監事審查,是採用3/4委員同意的高門檻,但這指的是全部15席委員的3/4還是出席委員3/4?並沒有明文規定。審查辦法是否要修改?修改後的法律層面問題,以及修改後能否立刻實施等事項,在會議中引發熱烈討論。
公視董監事審查委員 陳東升表示:「最低的標準1/2出席,7名;然後3/4通過,大概就是差不多5位、6位委員同意,就通過了。跟上次的全體委員的3/4,要到11位。」
公視董監事審查委員 蕭新煌表示:「別人可能有絕對不同的解讀,那個解讀,會變成政治化,而不是法律。我是覺得,我們不必去,今天急著去通過,去負擔這個所有罪過。」
歷經了將近2小時討論,最終委員投票表決,決議董監事審查會議修正3/4規則,但下次開會再實質審查。
文化部長 李永得表示:「規範並不是很周延,所以將來,如果公共電視有機會修法的話,我認為這部分,把它比較明確的規定,會是比較好一點。」
文化部長李永得指出,將來有機會修法的話建議要明確規定,才不會把壓力都丟到審查委員身上。根據財團法人法,第七屆董監事還沒有組成前,會由現任董監事延任,接下來還會持續進行溝通,至於下次會議何時召開,目前還沒有定案。
