Horizontal Auditing System to Be Completed in One Month 李義祥違兼工地主任 內政部:建示警系統

The Ministry of the Interior is setting up a management system after the Taroko derailment, which exposed the corrupted customs of borrowing license to bid on government projects in the construction industry. Lawmakers also criticized the Construction and Planning Agency for slacking-off on issuing penalties of violations. 


Scandals within the construction industry have surfaced in the wake of the numbered 408 Taroko train accident. Companies would bid on government projects by borrowing other company's name or the owner of a construction company illegally acts as the site manager. During a legislative session on April 12, the Minister of the Interior Hsu Kuo-yung said the Construction and Planning Agency is establishing a "management system for site managers", which is capable of alarming the authority if people are holding concurrent jobs. The system is expected to complete in one month. In the Taroko derailment case, Li Yi-hsiang, who was the owner of a subcontractor responsible for TRA's side-slope protection project, illegally doubled as the site manager. Li, Tung Hsin Construction Company, United Geotech and other related parties for the project are to be fined for the aforementioned violation.
 

The Ministry is setting up a horizontal auditing system in order to cross-check the construction companies. Right now, we have to cross-check the facts manually. We are hoping this auto-check system will be completed and can show preliminary result in a month.
 
Lawmakers also lashed out at the Construction and Planning Agency (CPA) for not fulfilling its due diligence in checking the chaos of license borrowing issues. Allegedly, it is reported that a license owner can even get NT$350,000 per year. In a report done by the Control Yuan in August 2019, it pointed out that the CPA's management system was incomplete and was inefficient in managing the license borrowing problem. However, the same problem wasn't addressed until now. The CPA said, cross-departmental amendments are required for the situation to be improved.
 
The Control Yuan had proposed the improvement in your management system back in 2019. If your system did raise red flags for Li Yi-hsiang, he wouldn't have doubled as the site manager and wouldn't have appeared at the site. Why didn't you change and improve the system back then? This requires cross-departmental cooperation between the Ministry of the Interior and the Public Construction Commission.
 
The market price for borrowing license is NT$350,000 per year. Article 28 clearly states that owner of a construction company cannot double as the site manager. Only four such violations have been issued in the past ten years. We should take a thorough look at how these rules are implemented.
 
According to Article 62 of the Construction Industry Act, it states that a jobsite director will be punished to stop working as a jobsite director after 3 warnings and the directors' practicing certificate will be abolished once the accumulated punishment term of stopping operation amounts to 3 years. Lawmakers also disclosed the fact that no jobsite managers' license have been revoked in the past 10 years and questioned whether the CPA and the local government have been slacking-off.
 
 
 
408太魯閣號事故,牽扯出工程界的「借牌文化」及李義祥負責人違法兼任工地主任亂象,內政部長徐國勇12號在立院備詢表示,目前營建署建立「工地主任管理系統」,就兼任情形提出示警,預計一個月完成,也將對李義祥違法兼任工地主任一事,開罰業主及工程單位。
 
內政部長 徐國勇表示:「現在大家想說,是不是橫向聯繫,讓他可以自動勾稽。事實上,現在手動往我們這邊查,查得到,這個自動勾稽,我們現在來建置,希望在一個月內,能夠有初步成果出來。」
 
不少立委砲轟營建署沒有落實稽查工程業借牌亂象,甚至有一年借牌價35萬元的行情;立委指出,根據2019年8月監察院報告就曾指出,營建署管理系統建置不全,未能有效管理借牌問題,至今未改善。營建署表示,仍要透過跨部會修法。
 
時代力量立委 邱顯智  vs. 營建署長 吳欣修表示:「(那時候它(監察院)就叫你這樣做了。今天李義祥如果沒有出現在被你的勾稽系統裡面找到, 他根本不應該擔任工地主任,他根本不會出現在那裡。你為什麼當時不去改?) 跟委員報告,這是內政部跟工程會,兩個必須要跨部會合作。」
 
民進黨立委 管碧玲 vs. 內政部長 徐國勇表示:「(借牌一年35萬是行情啦!28條營造業負責人,不得兼任工地主任,十年來罰4件。)我們立即來盤點這個施行細則。」
 
此外,根據營造業法第62條規定,工地主任違規,必須連續被警告三次才能暫停工地主任業務;停止業務累積滿三年才能廢止其執業證。立委也揭露,十年來沒有工地主任因此遭裁罰廢照,質疑營建署及地方政府裁罰鬆散。
