Detainee Uploads Video of Detention Room to TikTok 被告偷拍拘留所上傳抖音 被質疑管理鬆懈

A suspect that was detained at the Changhua District Prosecutors Office secretly recorded the detention room with his cell phone and uploaded it to TikTok. The office says detainees are allowed to have temporary use of their cellphone to make bail arrangements or if they are feeling unwell, but it will investigate for any administrative negligence that may have occurred.

This man filmed the room he was detained in and then uploaded it to TikTok with a soundtrack. Many are wondering why or how he had access to his phone. The Changhua District Prosecutors Office says the video is real and the room is where suspects or defendants awaiting trial are temporarily detained.

Yeh Chien-cheng, Chief Prosecutor, Changhua District Prosecutors Office: “The suspect that uploaded the video was arrested by police on July 30. Mr. Sun said he wanted to ask his family to bail him out and tell his family he was OK, so he was temporarily transferred to the detention room and allowed to make a phone call. We have confirmed this video is real. ”

A former judicial police official says cell phones are not allowed in the detention room unless the detainee is feeling unwell or there is some special circumstance, and they are definitely not allowed to record anything.

Former Judicial Police Official: “(Detainees) are allowed to call their families (to ask them) to bring bail money. The (judicial police officer) was negligent.”

The former official says police are overworked and can't keep watch over suspects every second. Prosecutors, meanwhile, say the suspect will be notified of the new charges against him. In the meantime, there will be an internal investigation to see if there was any negligence and supervisory measures will be strengthened.

四周都是軟墊，還有柵欄等相關設施，仔細一看場景是在法警室的保護室裡，但這段畫面卻被上傳抖音平台，還有配樂剪接。雖然只有短短十多秒，但被拘留的被告怎麼可以帶手機，也讓外界質疑。彰化檢方表示，經過追查這段畫面確實，是地檢署的保護室，是嫌犯或被告的暫時移置處所。

彰化地檢署主任檢察官葉建成表示：「外流影片者為7月30日，由警方拘提到案執行之被告，孫某因為被告開庭後，表示要請家人籌措罰金以及向家人報平安，考量被告需求，將被告暫時移置該室讓其撥打電話，由畫面的抖動跟角度，可確認其係乘隙偷拍。」

資深的前法警表示，保護室裡依照規定，不能使用手機，除非是犯嫌或被告身體不適，或是有特殊需求才會短暫允許使用，但依照規定不得錄影。

前法警說：「會讓他打電話回去家裡，（叫家人)準備錢來幫我交保，因為被人動了手腳，他(法警)自己也疏忽啦。」

前法警表示，因為勤務繁重，很難時時緊盯手機使用情形，而檢方強調，除了會通知偷拍的孫姓被告說明，對違法行為速查嚴辦，並議處相關行政責任。後續也將加強警戒、監控的措施。
