新任中選會委員6被提名人  立法院今審查Legislature reviews CEC nominees

Lawmakers focus on absentee votes, The Anti-Infiltration Act, and lowering the bars of deposite during the confirmation


Presenter: The Legislative Yuan is reviewing the list of nominees for Central Election Commission commissioners. When lawmakers asked about abolishing or reducing election deposits, the nominees said there is no need to change the system but the deposit amount can be adjusted.

On the 29th, the legislative Internal Administration and Judiciary and Organic Laws and Statutes committees reviewed the list of Central Election Commission commissioner nominees. The Anti-Infiltration Act, promulgated last year, bars citizens from accepting money or acting on instructions from "foreign hostile forces" to lobby for political causes, make political donations, or disrupt assemblies, social order, elections, and referendums. One lawmaker asked how the CEC would respond if it got this type of intelligence.

Lee Chin-yung, Chair, Central Election Commission vs Chang Hung-lu, Legislator (DPP):”

We are not (a) government (agency) and we have not received any intelligence of this kind. How are you not a government agency? Like I just said, the Anti-infiltration Act states that these parties are not allowed to have anything to do with referendums. Based on this, we should know that and we would pass any information we receive to the relevant judicial agency.”

Another lawmaker proposed abolishing or reducing election deposits to uphold the election participation rights of disadvantaged groups. Several of the nominees said no changes should be made to the system but the deposit amount can be adjusted. Others said deposits should be waived if a candidate gets enough signatures.

Wang Yun-jun, Nominee, Central Election Commission vs Chiu Hsien-chih, Legislator (NPP):”Our deposit and signature system is aimed at ensuring our candidates actually are serious about serving as elected officials. I personally think, hypothetically speaking, if you have a signature system, you can get rid of the election deposit. If we want to keep both, I would recommend keeping the (system) and lowering (the deposit amount).”

The six nominees were also asked for their stance on absentee voting. All of them said absentee voting can be tested in referendums first. Lee Chin-yung also said the earliest absentee voting could be implemented would probably be 2023.

 

 

立法院內政與司法法制委員會29日舉行聯席會議,審查中選會委員提名名單,由於去年新上路的反滲透法規定,不得受境外敵對勢力指示、委託或資助,捐贈政治獻金或經費從事公民投票案,有立委關心是否有這類情資,以及中選會會如何因應。

中選會主委 李進勇 vs. 民進黨立委 張宏陸:「我們不是主管(機關),也沒有接到這方面的情資

你怎麼不是主管。(我剛剛講了,反滲透法裡面有規定,他就不能從事任何跟公民投票的行為,我們基於這個職責,還是應該要知會,或者是告發或者是移送,相關的法律主管機關去做處理。)」

也有立委關心是否應該廢除或降低選舉保證金?保障弱勢族群參選權利,幾位被審查人都認為應該維持現有制度,但降低保證金金額,也有人認為如果有通過連署,可以考慮不用保證金。

中選會委員被提名人 王韻茹 vs. 時代力量立委 邱顯智:「因為我們保證金跟連署,都是為了要確保我們選舉人,這個被選舉人這個的認真參選的程度,那我會認為,如果假設有連署制度的情況底下。(我其實會贊成要廢除保證金這樣子,就是有連署制度,應該要廢除(保證金)啦,那如果說我們要維持兩個並行的話,那我就會建議是用二的方式,就是我們維持(制度),然後降低(保證金)這樣子。)」

六位被提名人也都對於公投不在籍投票,表達正向態度,認為先在議題性公投執行,將有助未來在選舉實施,李進勇也再度表示,以目前立法進度來看,可能最快在2023年實行。
