Legislator Aims to Increase Fines for Littering 在山林亂丟垃圾增 立委擬修法提高罰則

COVID-19 has brought on another ecological catastrophe as people now turned to domestic travels and littering in national parks have escalated. A lawmaker suggested to amend the laws and increase the fines for effective deterrence. The Construction and Planning Agency said that it has been submitting the draft amendment to the National Park Act since 2000 but its review has not been completed.
Wild birds are unable to fly because they are covered in plastic bags while kitchen utensils are being scattered everywhere in the mountain forests. These manmade environmental disasters are increasing and impacting forests on the island, as cross-border travel is limited in the COVID-19 era. A local village chief complained there is an overwhelmingly large amount of garbage, waiting to be cleaned every day.

Democratic Progressive Party Legislator Ho Chih-wei handed the garbage to the representative from the Construction and Planning Agency while pointed out mountain cleanups initiated by many civic groups have collected more than 22.5 tons of garbage in the last 10 years. However, only 12 tickets were issued for littering inside national parks from 2017 to October of 2020.
The fine for littering inside a national park is less than a thousand dollars while the fines for littering inside a scenic area under the Act for the Development of Tourism ranges from NT$5,000 to NT$1 million. I hope by holding this press conference today, the government would amend the regulations and make the fines even in both areas.
In response, the Construction and Planning Agency said that it has been submitting the draft amendment to the National Park Act since 2000. However, the reviewing of the draft has not been completed, leaving the proposed amendment in limbo since. The Agency did hold three meetings with related parties to discuss the draft after the Internal Affairs Committee reviewed it on October 5.
In the future, littering could be fined NT$3,000 to NT$300,000. Major violations could face a penalty of three years in jail and a fine of NT$10,000.
Ho Chih-wei suggested bringing the garbage to the litterer's house or office once the litterer is identified in order to effectively deter people from polluting national park.

台北市湖山里里長 李秋霞表示：「說真的，你要去抓根本沒有辦法，因為現在丟垃圾的人，都很聰明。他們是不會留下任何字跡的，你完全找不到。」
民進黨立委何志偉把垃圾包裹交給營建署代表，指出許多民間團體所發起的淨山活動，十年來在國家公園徒手撿出超過22.5噸的垃圾，但從106年統計到109年10月，棄置垃圾違反國家公園法者，真正有開罰的卻只有12件而已。
民進黨立委 何志偉表示：「在國家公園裡面，丟垃圾，一千塊有找喔！但是你在發展觀光條例，風景區，五千塊到一百萬。今天這個記者會，希望把罰則把它拉平，把它弭平，讓它一模一樣。」
建議提高罰鍰才能有效嚇阻，營建署回應，從民國89年起就陳送國家公園法修正草案，但因為屆期不續審的規定，一直沒有完成罰則相關修訂，本屆內政委員會在10月5號排審後，營建署已經三度召集相關單位研商。
內政部營建署國家公園組科長 鄔廸嘉表示：「未來依違法的情節，會處新台幣3千元到30萬元，另有刑罰，會加處三年有期徒刑，或併科新台幣一萬元的規定。」
自己的垃圾自己帶下山，何志偉建議，營建署如果查出垃圾丟棄者，應把垃圾寄到當事人的住處或公司，才能有效嚇阻民眾任意汙染國家公園的情形一再發生。
